The Great Falls clinic is extending their staff parking lot across the street from our condo association. They will have extended lighting and the cars are going to park in a way that their headlights are going to shine right in our bedrooms and homes at all hours-I work in healthcare, I know of the hours we all keep. Wouldn't Great Falls clinic be responsible for providing our condo association with privacy fencing? We do have a four foot open slot vinyl fencing on most of the condo units in the back. I'm asking for a 6 ft full closed paneled privacy fencing for all of the condo units affected affected. How do I go about this? They have lots of landscaping and trees galore and with the open slot that we have now I have an onslaught of leaves that has to be removed weekly... Not to mention the litter and garbage that get caught there from where are there garbage units set and their outdoor break area. I realize how windy it gets and I realize we have trees on our boulevard but the majority of those leaves come from the onslaught of trees required for beautification from the Great Falls clinic. I'd appreciate any feedback on how to go about this so I can approach the board of the directors of my HOA on how to proceed with the Great Falls clinic. Thank you for reaching out. City code does not require the Great Falls Clinic to provide your Condo Association with privacy fencing. There are buffer/screening requirements within 17.44.3.030(G) of the Landscape Chapter of the City code that apply when a non-residential use abuts a residential use. In this case, 29th Street South separates the two properties, and therefor those specific provisions do not apply.  What will apply is the general standards of the Outdoor Lighting chapter of the city code. The lighting levels of the on-site outdoor lighting will be limited to one foot-candle at the property line per 17.40.050(A). As far as the concern for leaves and other debris go, property owners are responsible for the maintenance of their own boulevard and property. There are no city codes that would require Great Falls Clinic to maintain the Condo Association property. Your Condo Association could certainly bring up these topics with the Great Falls Clinic directly and see if they are willing to help, but the City would have no involvement in those discussions.
